Terms and Conditions of Use for Vibe Event Rentals

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://www.viberentals.ca website (the "Site") operated by Party Rental Depot Inc. (doing business as "Vibe Event Rentals," "us," "we," or "our").
Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site.
By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Site.
1. Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Site.
You are responsible for safeguarding the password that you use to access the Site and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Rental Terms & Policies
Quotes & Booking Confirmation:
All quotes provided are valid for 5 days and are subject to change based on availability. A booking is only considered tentative until a retainer is paid. An order is not confirmed until you receive a written confirmation from us.
Payment Terms:
A non-refundable retainer is required to secure your rental items and date. The remaining balance is due in full prior to the scheduled event date. We accept credit card, e-transfer, wire transfer, cash. Credit cards may carry an additional fee.
Retainer:
All retainers are non-refundable. Retainers may be transferred to a new event date, subject to our availability and approval.
Delivery & Pickup:
We provide delivery and pickup services for all rentals. The customer is responsible for ensuring a safe and accessible path for the delivery and pickup of items. Delivery fees are based on the event location and will be confirmed in your quote.
Proper Use & Care:
All rental items are intended for indoor or covered outdoor use only. Items found left exposed to the elements (rain, sun, wind, etc.) may be subject to damage charges. Damage resulting from negligence, misuse, or failure to follow these use instructions will void any purchased Damage Waiver, and the customer will be liable for the full replacement value of the damaged items.
Damage, Loss, and Cleaning:
The customer is responsible for the rented items from the time of delivery until they are picked up by our team.
- Loss: Client will be charged the full replacement value for any lost items.
- Damage: Client will be charged for the full repair or replacement value for any damaged items. Damage from negligence voids the Damage Waiver and makes the client liable for full costs.
- Damage Waiver: If a damage waiver was purchased and is not voided by negligence, the first [$100] of damage is waived. Any remaining damage charges will be invoiced at 50% of the repair or replacement cost.
- Cleaning & Return Condition: Items are required to be returned free of waste and debris. Furthermore, the customer is responsible for returning items to the same location and configuration (e.g., stacked, bundled) as they were upon delivery. A fee for labour to retrieve, re-stack, or reorganize items will be applied if this condition is not met. A separate cleaning fee will be applied for items returned requiring excessive cleaning.
Cancellation:
Cancellations must be made in writing. The non-refundable retainer will be credited to your account for a future event upon cancellation less a 10% fee or $100, whichever is more. Cancellations made within [14 days] of the event date will be liable for 50% of the total rental fee. Cancellations within [48 hours] of the event will be liable for 100% of the total rental fee.
3. Intellectual Property
The Site and its original content, features, and functionality are and will remain the exclusive property of Vibe Event Rentals and its licensors. The Site is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Vibe Event Rentals.
4. Links To Other Web Sites
Our Site may contain links to third-party web sites or services that are not owned or controlled by Vibe Event Rentals.
Vibe Event Rentals has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Vibe Event Rentals shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
5. Termination
We may terminate or suspend your access to our Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
6. Indemnification
You agree to defend, indemnify, and hold harmless Vibe Event Rentals and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Site, or b) your breach of these Terms.
7. Limitation of Liability
In no event shall Vibe Event Rentals, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
8. Disclaimer
Your use of the Site is at your sole risk. The Site is provided on an "AS IS" and "AS AVAILABLE" basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Vibe Event Rentals, its subsidiaries, affiliates, and its licensors do not warrant that a) the Site will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components; or d) the results of using the Site will meet your requirements.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
10. Changes To Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site.

SMS Through GoHighlevel

- GoHighLevel is used to send and receive SMS messages relating to yuor inquiry for services or a current order you have with Vibe Rentals. Information about your delivery and pickups along with product specific instructions will be sent out.
- You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
- If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to contact@viberentals.ca or 403-735-6133.
- Carriers are not liable for delayed or undelivered messages.
- As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
